The activities proposed will be compatible with <br />existing agricultural and rural residential uses <br />in the neighborhood, as well as with projected <br />development in the future. <br />d. Use by Special Review Operations and Design Stand- <br />ards provide adequate protection of the health, <br />safety and welfare of the area and the County. <br />e. The subject site is in a Flood Hazard Overlay <br />District area. Operation Standards address this <br />concern. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- <br />missioners of Weld County, Colorado, that the application for a <br />Use by Special Review for an open-pit (wet) sand and gravel mine <br />on the hereinabove described parcel of land be, and hereby is, <br />granted subject to the following conditions: <br />1. The attached Operation Standards being adopted. <br />2. The following note being placed on the Use by Special <br />Review Permit plat: <br />NOTE: The hlined Land Reclamation Board has the <br />authority to issue permits for mining and <br />reclamation activities. Activities related <br />to mining and reclamation are, therefore, <br />under the jurisdiction of the Mined Land <br />Reclamation Board; however, Weld County has <br />jurisdiction of those matters outlined in the <br />Operation Standards. <br />3. The approved Operation Standards shall be placed on the <br />Use by Special Review Permit plat. The Use by Special <br />Review Permit plat shall be delivered to the Depart- <br />ment of Planning Services. <br />4. The applicant shall comply with Sections 26.2; 26.4.9; <br />26.5.2 and 53.7.1.2 of the Weld County Zoning Ordinance <br />in the event any portion of the Cache La Poudre River <br />is to be altered or relocated. Also, in the event of <br />the Cache La Poudre River alteration or relocation, <br />the Army Corps of Engineers (Permit Branch, Omaha, <br />Nebraska) shall be notified and the applicant shall <br />comply with Section 404 of the Clean Water Act, obtain- <br />ing a 404 Permit rp for to any stream alteration or <br />relocation. <br />5. Prior to the extraction of any sand and/or gravel <br />material from the Use by Special Review area, the <br />applicant shall offer and agree to an acceptable pro- <br />gram of road maintenance with the Weld County Commis- <br />sioners. The agreement shall mitigate impacts generated <br />on count}~ roads by the gravel mining operation.'s <br />truck traffic. The maintenance proposal shall address <br />maintenance of the haul routes on Weld County Road 13. <br />
