On November 28, 1989, he was served with a
copy of the publication and a copy of the application.
You will note the publication differed somewhat from your
suggested public notice format. First, there was an error
in your suggested format in that the County Clerk of Teller
County is in Cripple Creek and not Woodland Park. The
Woodland Park address you provided is the Planning
Department. A copy of the application was provided to the
County Clerk, but there is also a review copy at the
Planning Department. A copy of the receipt from the Teller
County Clerk submittal is also enclosed.
Although [he completeness letter date was November 16, 1989,
your completeness letter was not mailed until November 21
and was received on November 22. The publication was
submitted on the 22nd for publication on the 24th. If the
notice had not been submitted to the Pikes Peak Journal, the
paper in the Colorado Springs area which carries the most
legal notices and is read most widely by the environmental
community, publication would have been delayed until
December 1 which was well past [he 10 day deadline. We
suggest that your office make a concerted effort to mail
completeness notices faster than has been the case with this
application. Nevertheless, it appears that all the
necessary information and deadlines were met.
Respectfully,
/~~j~C~ ~'~ O
Mark A. Heffner
cc: Leigh Whitehead & Associates
