SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br />FOR: DR, JERIS A, DANIELSON, DEPUTY STATE ENGINEER <br />SUBJECT: AMICK PIT, RIO BLANCO COUNTY, APPLICATION FOR LIMTTED-IMPACT <br />MINING AND RECLAMATION PERMIT <br />As requested by your office, we have reviewed the application for a gravel pit <br />near Meeker. The applicant states in Exhibit D that 600 gallons of water per <br />minute will be required for gravel washing. The source of this water is a 1.3 <br />cubic feet per second portion of a 4 cfs share of the Miller Creek Ditch. This <br />ditch has, however, been decreed only for irrigation use, not for industrial <br />or mining purposes. The applicant should obtain achange-in-use decree from <br />the Division 5 Water Court in Glenwood Springs prior to the proposed use. If <br />this water is needed for dust control or other purposes, this information should <br />also be included in the Water Court application. <br />The applicant also states in Exhibit D that the landowner plans to construct an <br />irrigation pond to store ditch water and "serve as a pumping source for the <br />wash water", In order to store ditch water, the landowner may have to obtain <br />a storage decree from the Water Court unless the pond is very small and could <br />be considered an equalization pond. <br />We would recommend approval provided the applicant obtain the proper changes in <br />water rights for the operation, <br />,YP 4. <br />HDS/SSH:mvf Hal D.
