Mr. Richard Raines <br />April 25, 2005 Page 2 <br />Well permit no. 53502-F was obtained for the current use and exposed pond surface area <br />of the Kyger Pit in accordance with §37-90-137(2) and (11), C.R.S. Well permit no. 54295-F <br />was obtained for the current use and exposed pond surface area of the Three Bells Pit in <br />accordance with §37-90-137(2) and (11), C.R.S. Well permit no. 60890-F was obtained for the <br />current use and exposed pond surface area of the Port of Entry Pit in accordance with §37-90- <br />137(2) and (11), C.R.S. <br />It should be noted that the only consumptive use at the Three Bells Pit and the Port of <br />Entry Pit is the evaporation of exposed ground water. The Three Bells Pit is a mining reserve <br />and the Port of Entry Pit is currently in reclamation. Lafarge West, Inc. filed for a plan for <br />augmentation for the Port of Entry Pit site in case no. 2004CW111. The Kyger Pit is the only <br />active mining site and will continue to include evaporation, water retained in the product and <br />dust control. The mining operation at the Kyger Pit has continuously dewatered directly back to <br />the Cache la Poudre River since 2000. The estimated dewatering rate at the Kyger Pit site is <br />approximately 1,200 gallons per minute. <br />The source of replacement water for this combined plan will be from 5.0 Box Elder Ditch <br />shares. Lafarge owns 8.5 shares in the Box Elder Ditch and will use 5.0 shares in this combined <br />plan. The shares will be diverted into a recharge pit that was recently constructed on the un-mined <br />portion of the Three Bells Pit site. The recharge pit was excavated to only the upper portion of the <br />gravel deposit and will not expose additional ground water, thus no additional evaporative loss will <br />occur. Water will be diverted to the recharge pit through an existing lateral from the ditch. Lafarge <br />presently owns 5.5 shares of the 6.0 shares historically utilized for the irrigation of the Three Bells <br />property (344.3 acres). The historic consumptive use credit of the 5.0 Box Elder Ditch shares was <br />determined to be 255.9 acre-feet. This is based on an historic consumptive use analysis that was <br />completed in support of an augmentation plan in case no. 2002CW205. The 5,0 shares will be <br />diverted into the recharge pit each irrigation season. The return flow obligations from the Box <br />Elder Ditch will be maintained by the recharge plan. <br />Leases from the City of Greeley and The Lake Canal and Reservoir Company will make <br />replacements for depletions not covered by the recharge program. A lease of 15.3 acre-feet of <br />fully consumable water from the City of Greeley will make replacements from November 2004 <br />through March 2005. The point of replacement will be the Greeley Waste Water Treatment Plant. <br />A copy of the City of Greeley lease was provided to this office with the renewal request. A lease of <br />96.06 acre-feet of fully consumable water from The Lake Canal Reservoir Company will make <br />replacements from November 2004 through June 2005. A copy of the Lake Canal Reservoir <br />Company lease was submitted to this office on April 11, 2005. The source of the replacement <br />water will be from Gray Lakes, which can deliver water to Box Elder Creek and from there to the <br />Cache La Poudre River. Approximately 2.18 acre-feet of water from the Gray Lakes will cover <br />transit losses. <br />A monthly breakdown of the real time stream depletions from the mining operation as well <br />as the real time replacements made by lagged timing of the historic consumptive use credit is <br />shown in the attached Table 1. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S. subject to the following conditions: <br />1. Unless otherwise revoked or modified this plan shall be valid for the period of November <br />1, 2004 through October 31, 2005. If this plan will not be made absolute by a water court <br />
