J. E. Stover and Associates submitted a request on the permittee's <br />behalf for amendment of permit number CO-44776 on March 4, 1999. The Division drafted, submitted to <br />public notice and issued a permit amendment in response to this request. The effective date of this amendment <br />is August 1, 1999. <br />Your letter indicates that BRL is currently required to transport up to 150 Bowie Number 2 mine workers a <br />one-way distance of five miles to the Bowie Number l mine site on a daily basis to utilize the bathhouse there. <br />This amendment number L authorizes discharge from the new bathhouse at Bowie No. 2 mine. When <br />operational, this new bathhouse would eliminate the need for this daily transportation. Additionally, when this <br />new bathhouse becomes operational, the bathhouse at Bowie No. 1 mine will effectively be shut down. And, <br />by utilizing the bathhouse at Bowie No. 2 mine immediately, the company will realize a cost saving anf the <br />employees will realize a saving of time and convenience. <br />On the basis described herein, the Division will use enforcement discretion regarding discharges from outfall <br />002 at the $owie No. 2 mine that occur prior to the effective date of the final amendment, providing all terms <br />and conditions in the final amendment, including monitoring requirements, are adhered to that apply to such <br />discharges. The Division requests that all parameters shown in Patt I.B.I.d. of the permit be monitored at the <br />specified frequencies during this period, with one exception. Parameters specified as requiring monthly <br />monitoring should be sampled once per week during the interim period to demons rate that the WWTF is <br />complying with the applicable effluent limitations. The results of the monitoring performed prior to August L, <br />1999, should not be included on the discharge monitoring report (DMR), instead they should be tabulated in a <br />letter and submitted as soon as the results are available. <br />
