This water is located down-dip <br />(below) in the mined panel where Oxbow's longwall mining equipment was idled and <br />sealed in the mine due to a spontaneous coal combustion event in late January 1999. <br />As you know, in February approximately 88 acre-feet of water was pumped from the <br />North Fork of the Gunnison River into the mined longwall panel, covering the suspected <br />location of the combustion, but well below the elevation of the equipment. Other inflow <br />is apparently occurring at a rate of approximately 200 gpm. With the longwall equipment <br />being threatened by the rising water levels, Oxbow plans to begin pumping from the <br />mine through the original water infusion borehole and discharge it through a new pond <br />located along the river in NW1/4, SW1/4 Section 11, T73S, R90W, Sixth P. M. <br />Per your suggestion, Oxbow requests a minor modification to Permit # CO-0000132 to <br />discharge the mine water through the temporarily relocated Outfall 011. Oxbow will <br />utilize the new pond to treat the mine water, if necessary, and will discharge the water in <br />compliance with all parameters required for Outlall 011. After the Sanborn Creek Mine <br />has been rehabilitated, pumping from the in-mine sump to the current discharge point <br />location will be resumed. The temporary pumping location will then be discontinued. <br />So that Oxbow can proceed with the necessary CDMG permitting process, please <br />provide a letter to Oxbow today if possible, indicating your approval of this minor <br />modification request.
