<br />a. For rainfall [o waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hours after

<br />Should a precipitation event or snowmelt occur, the permittee shall submit adequate proof in order for an exemption to be claimed.
<br />Weather station data may be apppro riate in making this demonstration. Said proof shall be submitted as an attachment to the
<br />Discharge Monitoring Report (DMR~for the appropriate period. The Division shall determine the adequacy of proof. As part of this
<br />determination, the Division shall evaluate whether the permittee could have controlled the discharge in such a manner that primary
<br />limitations could have been met. All manual dewatermg of ponds that are equipped with automatic dewatering systems must meet
<br />TSS and total iron limitations. If a pond has only manual Sewa[ering capability, relief is available only [o [he extent required [o
<br />regain necessary stability and capacity.
<br />3. Post-Mining Areas
<br />In conformance with 40 CFR 434.50, commencing at the time active mining has ceased and all surface areas served by a
<br />sedimentation pond have been returned to the requved contour and revegetation has commenced, applicable discharges may be
<br />eligible for post-mining limitations. In most cases, these post-mining limitations shall remain in effect until bond release. The
<br />permmee shall notify the Division at the appropriate time so that consideration of permit modifications can be made. Prior to
<br />notification and subsequent permit modification, active mining limitations will apply regardless of actual mine status.
<br />4. Comoliance Schedule(s)
<br />a. Final Total Recoverable Iron Limitations: The pemtittee shall achieve compliance with the final effluent limitations for total
<br />recovera a uon o Part LA.1. ., a ecttve January 1, 2008, in accordance with a schedule of compliance approved by the
<br />Division.
<br />i. The permittee must, by June 30, 2005, submit a plan for approval that identifies operational changes, modification of the
<br />existing treatment system, or constmction of a new treatment system. A schedule of dates to accomplish various tasks
<br />related to the plan should also be included such that compliance with the final Total Recoverable Iron limitations may be
<br />attained.
<br />ii. The permittee must, by December 31, 2005 and December 31, 2006, submit progress reports summarizing the progress in
<br />implementing the plan such that compliance with the final To[a] Recoverable Iron ]'mutations may be attained.
<br />iii. The permittee must, by December 31, 2007, submit srudy results that show compliance has been attained with the final Total
<br />Recoverable Iron limitations maybe attained.
<br />Upon approval of the implementation plan by the Division, all terms and conditions of the implementation plan, including but
<br />not lmuted to the compliance schedule, will automatically become conditions of this permit.
<br />Progress reports must be submitted for tasks identified in the above schedule. Refer to Part I, Section D, Reporting
<br />Requirements, for specific information.
<br />No later than 14 calendar days following each date identified in the above schedule of compliance, the permittee shall submit
<br />either a report of progress or m the case of specific actions being requred by identified dates, a written notice of compliance or
<br />noncompliance, any remedia~ actions taken, and the probability of meeting the next scheduled requirement.
<br />A schedule for the elimination of the discharge, through connection to another treatment system or by other means, may be
<br />substituted for this schedule of upgrading.
<br />b. Salim~t + Sm~d The permittee must submit a report addressing salinity by December 31, 2006. Because there is no record that
<br />e pth ertnittee has previously submitted this report, a compliance schedule is included for the performance of the srudy.
<br />However, if a report has previously been submitted, the permittee should submit a copy of this report in lieu of the performance
<br />of another study.
<br />B. MONITORING REQUIREMENTS
<br />1. Frequency and Sample Type
<br />In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations specified in Part I.A.1, the
<br />permittee shall monitor all effluent parameters at the following frequencies. Such monitoring will begin immediately and last for the
<br />life of the ppemit unless otherwise noted. The results of such monitoring shall be reported on the Discharge Monitoring Report form
<br />(See Part I.E.).
