Please accept my apology for the failure to respond to your previous request in a letter <br />sent last yeaz. In reviewing the data collected over the term of the 5-Shaft seep monitoring program, the <br />Division of Minerals and Geology (DMG) agrees that it is appropriate at this time to consider its <br />discontinuance. You and I have discussed and tentatively scheduled a DMG inspection of the Climax <br />Mine on a date yet to be detemuned in September 2004. DMG suggests that the 5-Shaft seep monitoring <br />locations be inspected at that time, and the results of that inspection will be used inconsideration of <br />DMG's decision on your request to discontinue monitoring. <br />I will be in touch to schedule the inspection.
