• Section 778.16 <br />(a) Each application shall contain a statement of available information <br />on whether the proposed permit area is within an area designated unsuit- <br />able for surface mining activities under 30 CFR 764 and 765 or under <br />study for designation in an administrative proceeding under those Parts. <br />The permit area is not within an area designated unsuitable for <br />surface mining activities as defined in 30 CFR 761.11, nor is the <br />permit area under study for designation in an administrative pro- <br />ceeding under either 30 CFR 764 or 765. <br />(b) If an applicant claims the exemption in 30 CFR 786.19(d)(2), the <br />applicant shall contain information supporting the applicant's assertion <br />that it made substantial legal and financial commitments before January <br />4, 1977, concerning the proposed surface mining activities. <br /> <br />(c) If an applicant proposes to conduct surface mining activities <br />within 300 feet of an occupied dwelling, the application shall contain <br />the waiver of the owner of the dwelling as required in 30 CFR 761.12(e). <br />As stated in Section 778.16(a), 30 CFR 778.16 (b) and (c) are not <br />applicable to this application. <br />Section 778.17 Permit term information. <br /> (a) Each application shall state the anticipated or actual starting and <br /> termination date of each phase of the surface mining activities and the <br /> anticipated number of acres of land to be affected for each phase of <br /> mining and over the total life of the permit. ~`~234$6 <br /> <br /> . <br /> ~^ <br />~ ~ ~ '~ <br /> ~'~.
