Revised 11/20/80 <br />• <br />Parcel No. 4 <br />A parcel of land located in Section 26, which is more <br />particularly described as follows: <br />The E~SW'~y1~TE`~, the W~SE~IE~ and the E'~N1J~ySEZ, a total of 60 <br />acres. <br />On August 11, 1980, Kerr Coal amended its application to include a <br />fifth parcel and to change the location of diversion ditch F-1. On <br />October 21, 1980, Adrian Neisius of BLM advised Kerr Coal that the <br />application, as amended, was proceeding and that the BLM did not <br />anticipate any problems with it. Ne further advised Kerr Coal that <br />the Temporary Use Permit would issue prior to or simultaneously <br />with the approval of the mine plan by OSM. <br />Upon issuance, Kerr Coal will have the right to use the five par- <br />. eels of land encompassed by the Application for activities and <br />facilities necessary to protect the environment and to mine coal on <br />and adjacent to U.S. Coal Lease C-22777. <br />(5) COLORADO SPECIAL USE PERMIT N0. 41. <br />Effective July 14, 1980, from the State of Colorado, for the bene- <br />fit of Kerr Coal Company. <br />Township 8 North, Range 78 W of the 6th P.M. <br />A parcel of land, located in Section 2, which is more <br />particularly described as follows: <br />Beginning at the SE corner of Section 35, T9N, R78W; thence <br />along the North line of said Section 2, N 88°-52'-42" W, <br />189.03 Eeet, to NSJ corner of the E`~NE`~ of said Section 2; <br />thence along the West line of the E'~NE!~ of said Section 2, S <br />00°-02'-11" W, 1700.00 feet; thence N 62°-52'-30" E, 178.96 <br />. feet; thence N O1°-OS'-33" E, 1615.00 feet, to the point of <br />beginning; said parcel containing 6.61 acres, more or less. <br />778-19 as <br />
