Rance 78 West of the 6th P.M. <br />Parcel No. 5 <br />A parcel of land located in sections 25 and 26, which is more <br />particularly described as follows: <br />That portion of the old Jackson County Road 12E between the northern <br />• boundary of the Kerr Coal Company Property and its junction with the <br />relocated Jackson County Road 12E, (900 feet long, 35 feet wide) a total <br />of 0.66 acres. <br />The U.S. Temporary Use Permit (No. CO-010-TU-15) December 5, 1980 for <br />a period of five years. On April 10, 1985, prior to expiration of the <br />temporary Use Permit, Kerr filed a Right-Of-Way Application to replace <br />the temporary use permit. The Right-Of-Way Application covers the same <br />areas included in the Temporary Use Permit and authorizes use for the <br />life of the operation.
