PART II <br />Page 22 <br />• Permit Na. COG-850000 <br />B. RESPONSIBILITIES <br />5. Modification. Suspension or Revocation of Permits y the Division <br />(continued) <br />a) This permit may be modified, suspended or revoked during its term <br />for reasons determined by the Division including but not limited <br />to, the following: <br />(i) Promulgation of Water Quality Standards applicable to <br />waters affected by the permitted discharge; or <br />(ii) Effluent limitations or other requirements applicable <br />pursuant to the State Act or federal requirements; or <br />(iii) Promulgation of toxic effluent standards or prohibitions <br />(including any schedule of compliance specified in such <br />effluent standard or prohibition) which are established <br />under Section 307 of the Clean Water Act, where such a <br />toxic pollutant is present in the discharge and such <br />standard or prohibition is more stringent than any <br />• limitation for such pollutant in this permit; cr <br />(iv) Control regulations promulgated. <br />(b) A certification may be modified, suspended, or revoked in whole or <br />in part during its term for reasons determined by the Division <br />including but not limited to, the following: <br />(i) Violation of any terms or conditions of the permit; <br />(ii) Obtaining a permit by misrepresentation or failing to <br />disclose any fact which is material to the granting or <br />denial of a permit or to the establishment of terms or <br />conditions of the permit; or <br />(iii) Materially false or inaccurate statements or information in <br />the application for the permit; or <br />(iv) Data submitted pursuant to Part I.B indicates a potential <br />for violation of adopted Water Quality Standards or stream <br />classifications. <br />(c) The certification for the individual facility authorizing <br />discharge under the general permit may be modified to allow for a <br />change in ownership or operational control of a facility including <br />• addition, deactivation or relocation of discharge points where the <br />Division determines no change in the general permit is necessary. <br />
