o the Property (the "Coal"),~ pursuant to the terms of this

agreement;

~ WITNESSETH:
NOW, THEREFORE, for and in consideration o£ the
payments; mutual promises and covenants herein set forth, the
parties hereto agree as follows:
1. Grant o£ Mining Lease. Christy hereby grants
leases and lets to Crace all of the Coal together with the
exclusive right to survey, explore for and define the extent
and quality of the Coal; to develop, mine, stockpile, screen,
crush, remove, ship and market the Coal by Whatever methods
Grace may deem appropriate, including surface mining; and the
- right to dispose o£ coal, waste materials and overburden, all
to be done in compliance With the provisions o£ this agreement.
2. Term. The term of this Mining Lease shall be
from December 12, 1977, to and including December 31, 1998,
and so long thereafter as coal is being actively produced
from the Property.
