Cattany ' 29515 Routt Count Road No. 27 Division Director y Natural Resource Trustee Oak Creek, CO 80467 Re: Eagle Mine Complex, C-1981-044, Fourth Quarter 2002 Sediment Pond inspection Reports Dear Mr. Nettleton: The Division had notified RAG-Empire Corporation on December 19, 2003 that the Division had not received RAG-EC Fourth Quarter 2002 Self-Inspection of Ponds. The Division had verified that these inspections had been conducted during complete inspections at the mine site, but RAG-EC had not forwarded a copy to the Division, Inspection reports need to be sent to the Division on a quarterly basis in accordance with Rule 4.05.9(17). RAG-EC provided a copy of Fourth Quarter 2002 pond inspection reports to the Division on June 15, 2004. RAG-EC conducted the Fourth Quarter 2002 Pond Inspections on October 22, 2002, and October 31, 2002. Most of the ponds were dry. None of the ponds were discharging at the time of the inspections. No maintenance needs were identified on these sediment pond inspection reports. Inspection reports need to be submitted in a more timely fashion. Submittal of the fourth quarter 2002 pond inspection report completes the Division's request from our December 19, 2003 letter.
