The required fee of $217.00 for the <br />renewal of this substitute supply plan has been submitted. The original supply plan was approved on <br />becember 16, 1999 and it was most recently approved in a letter dated September 2, 2003. <br />The anticipated net depletion for this plan is 10.5 acre-feet per year, which includes <br />evaporation from up to 2.0 acres of ground wafer exposed after December 31, 1980. According to <br />the information submitted, no ground water was exposed within the reclamation permit boundary <br />prior to January 1, 1981. The mining operation has continuously dewatered directly back to the Big <br />Thompson River since 2000. The estimated dewatering rate at the Wagner/Kauffman Pit No. 3 site <br />is approximately 1000 gallons per minute. <br />The total estimated net depletions from this operation remain unchanged from the previous <br />plan. Water used at the Wagner/Kauffman Pit No. 3 will include 4.6 acre-feet of evaporative loss, <br />and 5.9 acre-feet of water lost with 200,000 tons of mined product. No phreatophyte credit has been <br />applied to this plan. <br />The proposed source of replacement for this pit is a lease of up to 15.0 acre-feet of fully <br />consumable water from the City of Loveland, including a 4 percent transit loss from Green Ridge <br />Glade Reservoir to Wagner/Kauffman Pit No. 3. The monthly depletions and replacement <br />requirements are found on the attached table. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan shall be valid through December 31, 2006 to coincide with the replacement water <br />lease term. If Phis plan wi(I not be made absolute by a water court action by the plan's <br />expiration date, a renewal request must be submitted to this office with the statutory fee <br />(currently $217) no later than November 15, 2006. <br />
