Discharges are authorized only from the following speci&c outfalls, as <br />shown on Figure 4 of the Pemtit: Outfall OOIA, which is the discharge to Arequa Gulch From the sedimentation pond located <br />downstream of the Valley Leach Facility (VLF) at monitoring point AG 1.5, which is located approximately 350 feet <br />downstream ofahe sedimentation pond crest, and Outfall OOSB, for qualifying precipitation related discharges from the <br />Valley Leach Facility at a point below Outfa11001 A. <br />[n accordance with the \Vater Quality Control Commission Regulations for Gfthient Limitations (5 CC'R 1002-62) and the <br />Color=ado Discharge Permit System Regulations (S.C.GR. 100?-6I ), the pemtitted discharge-shalt not contain eft~:cat <br />pamrneter concentrations, which exceed the limitations specified below, or exceed the specifed flow limitation. <br />- a.~ ~~~`a t)iccharge" (imitation fin• the \'i F ~~~~ ~ ~ ~ ~ ~ ~ ~ - - ~ -~- .~ <br />Except as allowed under the exemptions described in the sections below, there shall be no discharge from the VL.F, <br />pursuant to federnl effluent guideline regulations at 40 CFR, Pan 440.104.. Verbal notification <br />shalt be given within 24 hours, and written notification shall be submitted to the Division within 5 days of any <br />_ discharge from the VLF that would yuality for this exemption. -. ~ • <br />~, Stnm_ t FxetnTLOn From Fe~terd Fftlnrm t 'mi ~tiuns -nutfifl OQSR <br />Puntmnt to 40 CF'R, Part 440.131, if, as a result of precipitation, the Valley Leach Facility has a discharge, which <br />violates limitations of 40 CFR Part 440 or water quality standard based limits, the discharge may quality for an <br />.exemption from such limitations if the following conditions are met: <br />i} The facility is dcsigmed, constiucted and maintained to contain the maximum volume of process water stored and <br />contained by the facility during nomtal operating conditions without 1n increase in volume from precipitation and <br />the maximum volume of water resulting from a 10-year, 24-hour precipitation event. In computing the maximum <br />volume of water, which would result front a 10-year, 24-horn precipitation event, the facility must include the <br />volume, which would result from all areas contributing ntnofl'to the Valley Leach Facility (i.e., atl runoff not <br />diverted from the active ore leaching area). ;For the purposes of this permit, the 10-year 24-liour rainfall depth has <br />been determined to be 2.4 inches. - <br />ii) The perntiac`e takes all reasonable steps to minititizc the discharge. <br />iii) Atl notification requiremerris of the permit are complied with, including those listed below. <br />Verbal notification shall be given by fiC&V immediately to the Division upon becoming ae•are of an imminent <br />discharge and no later than 24 hour after the start of any discharge from the Valley (-each Facility that may qualify for <br />the exemption described herein. A report must be submitted within 5 days of the said dischargre, documenting that the <br />.facility was maintained to contain the previously specified volumes.
