The Division of Minerals and Geology (DMG or Division) received your Bonser Pit permit application for
adequacy.
Listed below are the DMG's comments on your new 112c application file number M-2000-156. The DMG
is required to make an approval or denial decision oo later than April 12, 2001, therefore, your response to
the following adequacy review concerns should be submitted to the Division by April 4, 2001, to allow the
Division time to adequately review your responses.
As required by Rule 1.6.5(2), please submit the proof of publication of the public notice circulated in
the local newspaper.
It also appears that the Big Thompson Ponds-State Wildlife Area may be within 200 feet of the
proposed disturbance. Was the State Division of Wildlife noticed?
2. Rule 6.4.6 Exhibit D-Minin¢ Plan
On Figure I-Exhibit D, the stockpiles are located south of each working pit, and the raw materials
stockpiles are located on the southeast portion of the permit area.
Please clarify if the piles are located in the 100-year floodplain and how they will be protected from
floods. Also, what measures will be taken to protect the Big Thompson River and the groundwater
from contamination from spills from the asphalt batch plant?
What measures will be taken to prevent surface water contamination if a flood from the river
inundates the batch plant area?
Please pro~~de more information on how the topsoil and overburden piles will be shaped and provide
slope information, i.e., pile heights and horizontal to vertical slopes. How will these piles be
protected from water and wind erosion?
3. Rule 6,4.7 Exhibit G-Water Information
On February 27, 2001 the Division faxed a "Response to Reclamation Permit Application
Consideration" memo, prepared by the Office of the State Engineer (OSE), to Peter Wayland of
Weiland Sugnet. In the memo, the OSE stated that the proposed operation will consume groundwater
and that "Prior to the initiation of these uses of groundwater, the applicant will need to obtain either a
