Long <br />Division Dnector <br />The Division of Minerals and Geology (DMG or Division) received your Bonser Pit permit application for <br />adequacy. <br />Listed below are the DMG's comments on your new 112c application file number M-2000-156. The DMG <br />is required to make an approval or denial decision oo later than April 12, 2001, therefore, your response to <br />the following adequacy review concerns should be submitted to the Division by April 4, 2001, to allow the <br />Division time to adequately review your responses. <br />As required by Rule 1.6.5(2), please submit the proof of publication of the public notice circulated in <br />the local newspaper. <br />It also appears that the Big Thompson Ponds-State Wildlife Area may be within 200 feet of the <br />proposed disturbance. Was the State Division of Wildlife noticed? <br />2. Rule 6.4.6 Exhibit D-Minin¢ Plan <br />On Figure I-Exhibit D, the stockpiles are located south of each working pit, and the raw materials <br />stockpiles are located on the southeast portion of the permit area. <br />Please clarify if the piles are located in the 100-year floodplain and how they will be protected from <br />floods. Also, what measures will be taken to protect the Big Thompson River and the groundwater <br />from contamination from spills from the asphalt batch plant? <br />What measures will be taken to prevent surface water contamination if a flood from the river <br />inundates the batch plant area? <br />Please pro~~de more information on how the topsoil and overburden piles will be shaped and provide <br />slope information, i.e., pile heights and horizontal to vertical slopes. How will these piles be <br />protected from water and wind erosion? <br />3. Rule 6,4.7 Exhibit G-Water Information <br />On February 27, 2001 the Division faxed a "Response to Reclamation Permit Application <br />Consideration" memo, prepared by the Office of the State Engineer (OSE), to Peter Wayland of <br />Weiland Sugnet. In the memo, the OSE stated that the proposed operation will consume groundwater <br />and that "Prior to the initiation of these uses of groundwater, the applicant will need to obtain either a <br />gravel pit or ocher type of well permit, as applicable.
