Cattany
Division Director
Natual Resource Trustee
The Division of Minerals and Geology (The Division) has received the Notice of Intent to
conduct coal exploration (NOI-2005-225-01), submitted 9 September 2005, and has
made the following findings:
1. The application is incomplete.
2. The project qualifies as coal exploration rather than coal mining.
3. Your project will substantially disturb the natural land surface. Therefore you will be
required to submit a bond to cover the cost of reclamation. The Division has
calculated the liability to be $41,221. A copy of the detailed estimate is enclosed.
The Division has found your application incomplete because it lacks the required
confirmation from a wildlife agency that exploration and subsequent reclamation
activities will not jeopazdize the continued existence of an endangered or threatened
species listed pursuant to Section 4 of the Endangered Species Act of 1973 (U.S.C. 1533)
or the Nongame, Endangered or Threatened Species Conservation Act (Section 33-8-10]
et sea. C.R.S.) or result in the destruction or adverse modification of critical habitat of
those species (Rule 2.02.2(2)(h)). The Division has forwarded information and a map to
the Colorado Division of Wildlife with a request for this information.
Office of Office of Colorado
Mined Land RE:clamation Active and Inactive Mines Geolo¢ical 5urvev
