<br /> <br />-g- <br />EXHIBIT F - Source of Legal Right-to-Enter <br />You must provide a description of the source that you base your legal right to enter the <br />site and conduct mining and reclamation. This could be a copy of the lease, deed, <br />abstract of title, or current tax receipt. A statement acknowledged by a notary public <br />that the operator has legal right to enter and mine is also acceptable. <br />Performance and Financial Warranties <br />You must submit a performance warranty and a financial warranty in an amount determined <br />by the Board prior to permit issuance.* Several different types of financial warranty <br />are allowed by the law. You should determine what type of financial warranty you desire <br />to use and obtain the appropriate forms from the Mined Land Reclamation Division during <br />the application review period to facilitate finalization of an acceptable financial <br />warranty a mi permit issuance. <br />Compliance With Other Laws <br />Section 115 of the Act requires a permit application be in compliance with all <br />applicable local, State and Federal laws. We suggest you contact the following agencies <br />to determines whether you need to comply with their legal requirements: <br />State Engineer with regard to the administration of water rights; <br />Colorado Department of Health with regard to the discharge of pollutants into the <br />waters of the State; <br />Colorado Department of Health with regard to the need for a fugitive dust permit; <br />and <br />U.S. Army Corps of Engineers regarding a dredge and fill permit. <br />* If the applicant is a unit of State or county government, then only a performance <br />warranty is required. <br />(Rev. 07/88) <br />2821E <br />
