r <br />f i <br />a road as is now proposed, and that Mr. Gray really intends only to get a permit now, with some <br />access that can not be contested on trespass grounds, with the intent to later switch access to the <br />Kinikin Road location(s) after the permit is in place. It is our concern that once a permit is <br />approved, such a change of access may not require the same notice to third parties and the same <br />level of scrutiny and other requirements of the MLRB. <br />Therefore, in order to avoid what we believe could be a backdoor way to seek approval of the <br />prior application, my client would respectfully request that the current permit not be ranted <br />unless an adequate plan clearly detailing the road specifications and estimated costs thereof have <br />been submitted, and proof of adequate funds to build the same in place; and we would also <br />suggest that any approval be clearly conditioned upon construction of that specific road within a <br />certain time frame, and that if such road is not so constructed, or if such road is later abandoned <br />for another road location, that an express term of the permit be that the current permit ends and <br />that a new permit needs to be initiated from the start. <br />By copy of this letter I am advising Mr. Roushar, who is Mr. Gray's attorney, and Mr. Scanlon, <br />who filed the Application on behalf of Mr. Gray, of this objection. <br />Cc Vic Roushar <br />Tim Scanlon <br />Client <br />Very truly yours, <br />~~,/~ <br />//~ <br />Rob J.
