• <br />Section 776.13 <br />(c) Terms of approval. Each approval issued by the regulatory author- <br />ity shall contain conditions necessary to ensure that the exploration <br />and reclamation will be conducted in compliance with the Act, this Part, <br />30 CFR 815, and the regulatory program. <br />Not applicable as indicated under Section 716.12; Kerr Coal will <br />not remove more than 250 tons of coal during the course of its <br />exploration. <br />Section 776.14 Applications: Notice and hearing for exploration of <br />more than 250 tons. <br />(a) The regulatory authority shall notify the applicant and the appro- <br />priate local government officials, in writing, of its decision to ap- <br />• prove or disapprove the application. If the application is disapproved, <br />the notice to the applicant shall include a statement of the reason, for <br />disapproval. The regulatory authority shall provide public notice of <br />approval or disapproval of each application, by publication in a news- <br />paper of general circulation in the general vicinity of the proposed <br />operation. <br />(b) Any person with interests which are or may be adversely affected by <br />a decision of the regulatory authority pursuant to Paragraph (a) fore- <br />going, shall have the opportunity for administrative and judicial <br />review as are set forth in 30 CFR 787. <br />As indicated under Section 776.12, Kerr Coal will not remove more <br />than 250 tons of coal during the course of its exploration. <br />u <br />776-9 <br />
