That is one of <br />the points I want to make. The second point, which I think is, unless that's <br />hidden in the application somewhere else a]so, I think it -- although I don't <br />think it is, 'cause I think everybody has pretty well stated that the water <br />rights are going to be obtained... <br />MR. MASSEY: That's correct. <br />MR. N. COHEN: ...hopefully. Because, you don't have any now. And, <br />that's probably the critical issue, because that is where Exhibit G of the <br />Rules -- and I guess the complete cite -- yeah, page 37 -- Subpart D at the <br />bottom... <br />MR. COHEN: Subsection D says that the operator shall indicate the <br />water rights and sources of water to supply the project water requirements. <br />That's the first part. That's not been satisfied, because there's no where in <br />the -- no where in the application is that indicated. <br />Number two, the sources and rights should be investigated by the Board <br />utilizing avai]able sources to obtain the necessary information in a timely <br />manner, prior to the Board's consideration of the application. Mr. Banta's <br />comment that there's no provision for sequencing, I think, is contradicted by <br />this sentence. I think there is a provision for sequencing, and I think that <br />your consideration, what you are doing here today, your consideration of this <br />application without an evaluation or investigation of the water rights is <br />premature. And these -- and these are your Rules -- and if... <br /> <br />
