Smith Pit #5,110c Decision Letter -Performance Warranty Request -for <br />Construction Material Operations that do not Require a Financial Warranty <br />Deaz Mr. Champ: <br />On August 27, 1981, the Division of Minerals and Geology approved an 110c permit application which included <br />many different sites. At that time each site should have been assigned a separate permit number, but this was not <br />done. After many different site inspections and correspondence between Division staff and Washington County <br />representatives over a period of time the Division believes that this situation has been resolved. In sutnmary, this <br />is the current situation: <br />1. Pernut Number M-1981-125 was issued on August 27, 1981 under the site name of Gebauer Pit. This pit <br />was released during 7uly of 1992. <br />2. Pit No, 2, the Shook Pit, was inspected on October 3, 2002, at that time the Division stated that, "if the <br />County can obtain a leiterfrom the Landowner that he is satisfied with the current condition of Pit No. 2 <br />the Division will release this pit." The Division received a letter from Jeremy Shook asking that the <br />County be released from this pit. The Shook Pit is therefore no longer covered by any Division permit, <br />3. At the time of the October 3, 2002 inspection Larry Champ, the Washington County District #3 Road <br />Supervisor, stated that the current pit being operated under Pemlit M-1981-125. is the Dmllinger Pit, <br />therefore Permit No. M-1981-125's pit name will now be referred to as the Drullinger Pit. <br />4. Pit No. 5, referred to as the V.F. Smith Pit, is not currently not being mined by the county, but has been <br />operated by someone in the last ten or so years. Since [his site was permitted under M-1481-125 by the <br />County, and since it has not been reclaimed, the Division will hold the County responsible for the <br />reclamation. Also, since perarit M-1981-125 is now assigned to the Drullinger Pit a new permit number <br />has been issued to the County for the V.F. Smith Pit-Permit M-1981-309. <br />5. Through a series of inspections from 1982 to 2002 the Division has determined that al] the other site <br />locations originally permitted in 1981 under M-1981-125 were never disturbed or had been reclaimed <br />either by an operator or landowner or through natural processes. Therefore, Permit No. M-1981-125 now <br />covets only one pit, the Drulinger Pit. <br />The Division is enclosing a performance warranty for Permit M-1981-309 to complete the "clean up" of this entire <br />situation.
