Owen • -2- • December 7, 1934 <br />Questions Concerning All Ten Applications <br />Exhibit A - Legal Description <br />The shortened form of the legal description given both in Exhibit A and in the <br />performance warranty needs to be expanded into a more standard form. Yith <br />your permission, I will interpret Exhibit A for all of the pits to mean the <br />following: The first number will be the Section number; the second nu~ber <br />will be a Township South; and the third number will be a Range West of the <br />6th P.M. Again, with your permission, I will change the Exhibit A page on the <br />ten performance warranties to reflect this more standard format. Thus, for <br />the Earl Forristal Pit (file no. M-84-180) the legal description of "NE 1/4, <br />NtJ 1/4 30-12-54" becomes "NE 1/4, NW 1/4, Sec. 30, T12S, R544! of the <br />6th P.h1.", and the other mine operations are treated in like fashion. Please <br />confirm to me that you have no abjection to this change for these legal <br />descriptions. <br />Exhibit B - Mining Plan <br />1. For each of the ten operations, an estimate of the life of the ®ining <br />operation should be given. If any or all of the operations are truly <br />indefinite in duration, please try to give a best guess for the probable <br />duration of mining. <br />2. The depth of mining in each pit should be given. <br />3. It is evident that each of these pits will be mined somewhat <br />sporadically. You should state that these operations will be mined for less <br />than 180 days/year as apart of the plan, and that this irregular use should <br />not be construed to mean that any of these operations should be considered to <br />be in temporary cessation of operations. <br />4. Although the availability of topsoil on the sites is variable, Lincoln <br />County should commit to salvaging all available topsoil, in each case. <br />Topsoil stockpiles should be placed away from the active mining areas and <br />planted with a perennial grass cover crop for purposes of stabilization <br />against wind and water erosion. The Soil Conservation Service can recommend <br />an appropriate cover species and seeding rate for this purpose. <br />5. Planned depth of topsoil removal should be given where it can be <br />specified. <br />6. In each case where the basic mining plan is to extract from a stream <br />channel, any topsoil stripped should be stockpiled outside of the channel, <br />above the high-water mark. Product stockpiles should also not be left for any <br />long period of time. <br />
