Accordin~to the information
provided, the File Pit II site was designated as a 111 c special permit that identified a pit area of approximately
13.4 acres. The site is being proposed for expansion and therefore a new permit application has been filed
with the Division of Minerals and Geology to convert the site to a 112 permit.
The anticipated net depletion under the current substitute water supply plan was 11.13 acre-feet per
year. The mining at this site was supposed to begin in October of 2003 and cease at the end of May 2004.
You indicated that during the first six months the operator extracted the upper sand and was not able to
extract the gravel below. The well permit and the substitute water supply plan was developed for the purpose
of extracting the gravel below the ground water table. Under the current substitute water supply plan, the total
surface area of the gravel pit ground water pond is limited to 0.30 acres in the dewatering trenches and the
use of the ground water is limited to 0.177 acre-feet of evaporative loss, 10.68 acre-feet of water lost with the
mined product (based on 362,000 tons of aggregate), and 0.3 acre-feet of water used for dust suppression.
The current plan is valid through May 31, 2005.
Since the current substitute water supply plan for the File Pit II is still valid, mining can continue under
the current substitute water supply plan as long as the total surface area of the gravel pit ground water pond
would not exceed 0.30 acres in the dewatering trenches and as long as the use of the ground water would not
exceed the amounts listed in the current substitute water supply plan. However, a new substitute water supply
plan and a new well permit will be required for any expanded use under the new mining application.
Please contact loans Comaniciu if you have any questions concerning this matter.
Sincerely,
cc: Dave Nettles, Assistant Division Engineer
Bob Carlson, Water Commissioner District 6
Division of ~.linerals and Geology
Jeffrey J.
