<br />THIS PERPfIT is issued this 9th day of February, 1979 by the Mined Land
<br />declamation Board, Department of Natural Resources, State of Colorado.

<br />S?HEREAS, Colorado Aggregate Co., Inc. desires to conduct a(n) open mining
<br />operation, known as Mesita Hill Pit , for the purpose of extracting open
<br />~~;ned scoria and
<br />4:uEF.f~\S, on September 28 1077 Colorado Aggregate Co.,lnc. "FILED" an
<br />application,a reclamation plan and map, and the required fee, as required by law; and
<br />hT~ERLIS, on December 15 19 77 the `4ined Land Reclamation Board approved
<br />Colorado Aggregate Co., Inc. application and set bond; and
<br />l•.1iERE`,5, on February 9 14 77 the `tined Land Reclamation Board accepted
<br />suret~: suhmitted by Colorado Aggregate, Co.,lnc. and such date shall be considered the
<br />date of iss.:auce o[ the permit and the anniversary date for all other purposes; and
<br />i,?IEREAS, the ?lineal Land Reclamation Board has made a fi^.ding, fur the purposes
<br />of issuing this permit, [hat:
<br />1) t^e application complies with the regcirements of the Colorado
<br />*[ined Land F.eclamation Act ar.d all applicable local, state and
<br />Federal la~.~s; and,
<br />2) the cceration will not adversely affect the stability of any
<br />significant, valuable, and permanent ms-,-made structures located
<br />wi.thiu two :nundred .`eat of *_he. affected land, e::cept where there
<br />is an agreement between the operator and the persons having an
<br />interest in the structure that damage [o the structur= is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in cunfor:uance with the rcqu;rements of G.R.S. 1973, 34-3?-116, as
<br />nr.:rndcd (1975 Sass. Laws H. L'. lOG=); and
<br />SlHER~:15, for the purposes cf issuing this permit, the operator has made a
<br />_stisEacw ry showin.~ to the Board that he will employ during and after his
<br />open min?.ng operations procedures reasonably designed to minimize
<br />:c. much as pr::.:eitable the disruption from [hc open mining operations
<br />and wi].1 prc•vide Cor the rehabilitation oC the affected land through the rehabilitation
<br />of plant cover, soil stability, water resources, and other measures appropriate to the
<br />subsequent beneficial cse of such nixed and reclaimed lands; and that in [he event
<br />cf the failure of his proposed reclamation plan, he will take whatever measures which
<br />:nay be necessar;~ in order to assure the success of reclamation of the lands affected
<br />. his open mining operations; and,
