<br />The sources of legal right to enter and conduct mining operations on the affected lands are as follows:
<br />1. Federal Coal Lease D- 044569, issued August 30, 1934 as extended and modified by the United States of America as
<br />lessor, to Tony Bear as original lessee, assigned to Atlantic Richfield Company by Assignment to Coal Lease dated July
<br />20, 1970, effective April 1, 1971, and assigned to West Elk Coal Company by Assignment of Lease dated June 5, 1984,
<br />embracing the following described lands in Gunnison County, Colorado:
<br />Township 13 South, Ranee 90 West, 6' P.M.
<br />Section 9: Lots 1, 2, and 3, and the S1/ 2SW1/ 4SW1 /4or that part of the SW1/4SW' /4 south of the North Fork of the
<br />Gunnison River.
<br />Section 15: W I/2 W1/2 SWIM (Removal of coal is limited to "F" Seam located west of Sylvester Creek.)

<br />Lease dated November 22, 1968, effective April 1, 1969, and assigned to West Elk Coal Company by Assignment of
