<br />THIS PER`SIT is issued this 28th day of July, 1978 by the Mined Land
<br />Reclamation Board, Department of Natural Resources, state of Colorado.
<br />W ITN E S S E T H
<br />WHEREAS, Colorado Lien Company desires to conduct a(n) open mining
<br />operation, kno NEWETT QUARRY , for the purpose of extracting open
<br />wined limestone; an ,
<br />WHEREAS, on Plarch 17, 19 7a Colorado Lien Company "FILED" an appli-
<br />cation, a reclamation plan and map, and the required fee, as required by law; and
<br />WHEREAS, on .lone 29, 19 78, the Mined Land Reclamation Board approved
<br />The Newett Quarry application and set bond; and
<br />WHERt.AS, on July 28, 19 78, the Mined Land Reclamation Board accepted surety
<br />submitted by Colorado Lien Company and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />WHEREAS, the Mined Land Reclamation Board has made a finding, for the purposes
<br />of issuing this permit, thaC:
<br />1) the application complies with the requirements of the Colorado
<br />!lined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and,
<br />2) the operation will noC adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feeC of the affected land, excepC where there
<br />is an agreement between the operator and the persons having an
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; ard,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conformance with the requirements of C.R.S. 1973, 34-32-116,
<br />as amended (1976 Sess. Laws H.B. 1065); and
<br />'nY.ERcAS, for the purposes of issuing this permit, the operator has made
<br />a satisfactory skewing co the Board that he will employ during and after his
<br />open mining operations procedures reasonably des_gned to minimice
<br />as practicable the aisruption from Che open mining operations and •~!::
<br />provide for the rehabilitation of the affe~Ced land through the rehabilitac!:n of
<br />cover, soil stability, water.resources, and ocher measures appropriate to the
<br />subsequent. beneficial use of such mined and reclaimed lands; and thaC in
<br />the event of the failure of his prcposed reclamation plan, he will take whatever
<br />measures which may be necessary in order to assure the success of reclamation of
<br />the lands affected by his °pe° mining operaticns; and,
<br />'W'HEREAS, for the purposes of issuing this permit, a copy of the application
<br />approved by the `tined Land Reclamation Board of the State of Colorado is attached
<br />to this permit and thereby becomes a par;. of [he terms hereof.

<br />NOW, THEREFORE, pursuant to [he authority set Eorch in the Colorado `fined
<br />Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, (1976
<br />Sess. Laws H.B. 1065).the Mined Land Reclamation Board of the State of Colorado
<br />hereby lseues a life of the mine permit to Colorado Liea Company to engage iii
<br />°~'~" mining for the purpose of extracting open
<br />mined limestone .,n the following parcel of ground, to wit:
<br />26 Acres contained in portions of the S'~ NWT, NEB SW}, NWT SW~, W'~ SGT NEk,SW'~ NE'~NWiy SE'y,
