The Service's Colorado <br />Field Office should be contacted immediately for further guidance if a field survey identifies the <br />existence of one or more active bird nests that cannot be avoided by the planned work. <br />Adherence to these guidelines will help avoid the unnecessary take of migratory birds and the <br />possible need for law enforcement action. <br />The Colorado Division of Wildlife (CDOW) maintains records of eagle nest locations in the <br />state, and the Service coordinates closely with CDOW regarding appropriate buffers around <br />eagle. Although a golden eagle nest is know from the project vicinity, it is our understanding <br />that it is at a distance that suggests impact to the eagles from on-site operations would not be <br />likely. <br />CDOW is also the best source of information regarding potential impacts of the project on elk <br />and deer, and may be helpful in suggesting appropriate site restoration following mining.
