<br /> <br />conducting its operations or may conduct such operations in <br />the future. <br />12. After the expiration of the first five years of <br />the lease term and payment by Lessee to Lessor of the royalty <br />required by paragraph 7E above, the Lessee shall be privileged <br />to terminate this Lease Agreement by written notice to the <br />Lessor and thereafter this Lease Agreement shall be void and of <br />no further force or effect except the obligations imposed upon <br />the Lessee for reclamation of the property as set forth above. <br />13. In the event that all or any part of the leased <br />premises are encumbered by any lien at the time of execution <br />hereof, the Lessor shall obtain a written subordination of any <br />such lien or encumbrance to the rights of the Lessee hereunder, <br />and upon failing so to do the Lessee may declare this lease <br />void at its option. If this Lease Agreement is declared void <br />pursuant to this paragraph, any advance royalty paid to the <br />Lessor shall be repaid to the Lessee upon demand therefor. <br />14. Prompt payment of the amounts herein agreed upon <br />to be paid by Lessee and compliance with all terms and conditions <br />herein expressed is of the essence of this Agreement,. and if <br />Lessee shall fail to make said payment or payments or shall fail <br />to keep and perform the covenants herein contained, Lessor may <br />give Lessee written notice of his intention to cancel this <br />contract thirty days after such notice is given to the Lessee <br />unless within said thirty-day period the default complained of <br />shall have been cured, and if not cured at the end of said <br />thirty-day period, this Agreement shall become null and void, <br />and Lessee shall forthwith remove all of its property and <br />vacate the premises, and any advance royalty paid to Lessor shall <br />be retained by Lessor as his sole and separate property. <br />15. Any written notice required pursuant hereto may <br />be given by certified or registered mail, return receipt <br />requested. Any such mailing to the Lessee shall be to the <br />-5- <br />
