Everi~ SUMMIT County, <br />State of Colorado, hereinafter called the "Grantor," for and in consideration of the sum of ONE <br />DOLLAR ($1.00), and other valuable consideration in hand paid by the DEPARTMENT OF <br />TRANSPORTATION, STATE OF COLORADO, hereinafter called the "Deparmlent," receipt of <br />which is hereby acknowledged, has given and granted and by these presents does hereby give <br />and grant unto the said Department RIGHT-OF-WAY and EASEMENT on, along, over and <br />across the following described premises, to-wit: <br />DESCR1PTiON <br />A temporary easement No. TE-1 B containing 499,996 sq. ft./11.478 acres, more or less in <br />Lot 12, Arapaho National Forest lying in the S W 1/4 Section ] 0, Township 4 South, Rattge 78 <br />West of Sixth Principal Meridian, in SUMMIT County, Colorado, said easement being more <br />particularly described as Follows: <br />Beginning at the West Quarter Comer of said section 10 ;Thence S. 32° 58' 12" E., a <br />distmce of 520.237 meters (1706.81 feet) to a point on the existing southwesterly Right-of--Way <br />line of State Highway 9, same point being the TRUE POINT OF BEGINNING; <br />l . Thence S. 49° 07' 38" W., a distance of 304.801 meters <br />(1000.00 feet); <br />2. Thence S. 40° 52' 22" E., a distance of 152.400 meters <br />(500.00 Y'eet); <br />3. Thence N. 49° 07' 38" E., a distance of 304.724 meters (999.75 feet) to point on the <br />existing Southwesterly Right-of--Way line of State Highway 9; <br />4. Thence along said existing Right-of--Way line, along the arc of a crave to rile left having a <br />radius of 1149.013 meters (3769.72 feet), a distance <br />of 13.240 meters (43.44 feet), (Ute chord of said <br />arc beazs N. 40° 32' 35" W., a distance of 13.240 <br />meters (43.44 feet) ); <br />5. Thence N. 40°52' 22" W., continuing along said existing Right-of--Way line, a distance of <br />139.160 meters (456.56 feet), more or less, to the TRUE POINT OF BEGINNING. <br />The above described Temporary Easement No. TE-1B contains 4.645 hectares/46451.2 <br />square meters (1 1.478 acres/499996 square feet), more or less. <br />For the purpose of: erosion control. <br />Subject to the following terms and conditions: <br />1. Upon completion of construction, area disturbed will be restored as neaz as <br />possible to its original condition. <br />2. The Temporary Easement will be in effect for 18 months from the starting date of <br />construction. <br />The existing fence will be replaced in kind. <br />
