Colorado htined Land Reclamation Board Hearing Process: Typically, any application far a 112 Regular Operation permit or an amendment to a 112 Rzwlar Ooeration permit requires a hearing before the biined Land Reclamaton Board when these is a wriaen objection. However, prior to the Formal Board Hearin„ several other hearings must occur prior [o the Formal Board Hearing. The Informal Conference: The first of the three hearings in the process is the Infornta] Conference. If there are objections-or at the reques of the applicant or local boazd of county commissioners -the Division will schedule an informal conference anion thz parties. The Informs] Conference is held af[er the close of the required comment period, which is about 50 to 60 days from the date an application is considered filed with the Division. The purposes of the informal conference are to: • Explain the three hearing process to the patties • Identify the issues • Identify the patties • 'Determine what issues have been resolved • Determine if any parties want to withdraw The Pre-hearing Conference: The second hearing is the Pre-hearing Conference. It can occur no sooner than t7m days afrer the Division has made iu recommendation to approve or deny the applicarion for a permit or amendment, However, it must also occur at ]east five (5) days prior to the Formal Boazd Hearing.. The Pre-hearing Conference is usually.conducted by amember ofthe Mined Land Reclamation Boazd. The Division is required to mail its recommendation to all parties prior to the Pre- hearing Conference. The purposes of the Pre-hearing Conference aze to: • Recotnmrnd the issues the full Board should consider • Determine the lists of witnesses and exhtbiu to be presented by the parties at the Formal Public Hearin • Determine the amount of time each party will have to make their presentations at the Formal Public' Hearing • " Prepare a Draft Boazd Order that will be used to conduct the Formal Board Hearing The Formal Board Hearing: The Formal Boazd Hearing must be held prior W the automatic approval date for the permit application or the amendment. At the Formal Boazd Hearing, the first order of business is for the Boazd to adopt the Draft Board Order. Parties may object to the Draft Boazd Order and seek revisions. Qnce the Daft Board Order is adopted, the Formal Board Hearing begins. . Oa occasion, an operator may have a consultant represent the operator or company. In order to represent the applicant or dperator, the Board and the Attorney General's Office have requested that consultanu complete a notarized form of desi~ation.
