OXBOW MINING, INC. <br />Permit No. 98GU0812 <br />Initial Approval <br />Page 5 <br />In addition, the following requirements of Regulation No. 6, Part A, Subpart A, General Provisions, <br />apply. <br />a. At all times, including periods of start-up, shutdown, and malfunction, the facility <br />and control equipment shalt, to the extent practicable, be maintained and operated <br />in a manner consistent with good air pollution control practices for minimizing <br />emissions. Determination of whether or not acceptable operating and maintenance <br />procedures are being used will be based on information available to the Division, <br />which may include, but is not limited to, monitoring results, opacity observations, <br />review of operating and maintenance procedures, and inspection of the source. <br />(Reference: Regulation 6, Part A. General Provisions from 40CFR60.11) <br />b. No article, machine, equipment or process shall be used to conceal an emission <br />which would otherwise constitute a violation of an applicable standard. Such <br />concealment includes, but is not limited to, the use of gaseous diluents to achie•re <br />compliance with an opacity standard or with a standard which is based on 11ie <br />concentration of a pollutant in the gases discharged to the atmosphere. 1§ 60.12) <br />c. Written notification of construction and initial startup dates shall be submitted to <br />the Division as required under § 60.7. <br />d. Records of startups, shutdowns, and malfunctions shall be maintained, as requinad <br />• under § 60.7. <br />A copy of the complete applicable subpart is attached. <br />16. The process equipment are subject to the process weight rate of Regulation Number 6, Part B, III., <br />C. as follows: <br />For those pieces of equipment with process weight rate of 30 tons per hour or less, pounds per <br />hour emissions of total particulates shall not exceed 3.59•P'°~, where P =hourly process weight <br />rate (tons per hourl. <br />For those pieces of equipment with process weight rate of more than 30 tons per hour, pounds per <br />hour emissions of total particulates shall not exceed 17.31 •P°''°, where P =hourly process weight <br />rate (tons per hourl. <br />17. Prior to final approval being issued, the applicant shall submit to the Division for approval an <br />operating and maintenance plan for all control equipment and control practices, and a proposed <br />record keeping format that will outline how the applicant will maintain compliance on an ongoing <br />basis with the requirements of condition numbers 4, 5, 6, 14, 15, and 16 listed above.
