III IIIIIIIIIIIII III <br />999 <br />Mountain Coal Company <br />West Elk Mine <br />Final Certification <br />RPE Sediment Ponds <br />In accordance with Section 4.05.6 of the Rules and Regulations for coal mining administered by <br />the Colorado Division of Minerals and Geology, this certification covers the design and <br />construction of a two-cell refuse pile sediment control pond at the West Elk Mine. This facility, <br />known as the RPE Sediment Ponds, was permitted under Technical Revision No. 79 of Mountain <br />Coal Company's Mining and Reclamation Permit No. C-80-007. <br />The undersigned, Eric W. Mende, P.E., has 17 years of design and construction experience, and <br />has been a registered professional engineer in the State of Colorado for the past 1 1 years. Mr. <br />Mende was the Project Civil Engineer responsible for overseeing the design and construction of <br />the subject ponds. Mr. Mende reviewed and approved construction specifications, design <br />drawings and proposed field changes, and also performed both "in-progress" and "final" <br />inspections of the installation. <br />Certification: <br />I, Eric W. Mende, P.E., do certify that: <br />The RPE Sediment Ponds were designed in compliance with prudent and generally accepted <br />engineering practice, and were constructed to the specifications, lines, grades, and elevations <br />required for a fully functional installation. The RPE Sediment Ponds comply with the approved <br />mine plan and permit, specifically E.~chibit 66 of Permit No. C-80-007, as revised. <br />September 30, 1997 <br />Eric W.
