The issuance of this penult does rwt ensure that <br />no injury will occur to another vested water right w pretlude another owner of a vested water nght from seeking relief in a dull court action. <br />2) The conshudiar of this well shall be In crnrlpliance with the Water Weil ConsWction Rules 2 CCR 402-2, unless approval of a variance has <br />been granted by the State Board of Examiners of Water Wall ConsWdbn and Pump Installation Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-94137 (2) and (11) fw the wnstructlon and operation of a wall (gravel pit pond) in accwdance with the <br />temporary substltute water supply plan approved by the State Engineer on Odober 15, 2006, fw the Latham Burke[I Pit, Olvision of Minerals 8 <br />Geology Permit Number M-1980-013. The well (pond) shall not be operated unless it is induded in a substltute water supply plan approved by <br />the State Engineer w a plan krr augmentation approved by the Water Court. The water suppy plan for this pit Is cunently valid through <br />October 14, 2008 and If it is not extended w ff a court decree is not entered far a plan for augmentaton, diversion of ground water from this <br />well must cease Immediately. <br />4) The average annual amount of ground water ro be appropdated shall not exceed 37.53 eve-feet with the total surface area of the proposed <br />ground water pond limited to 14.5 ayes. <br />5) The use of ground water during mining is limited ro evapomtlon (25.67 acre-feetlyear) fw 74.5 ayes of exposed groundwater in the <br />dewatering Vench, settling ponds, wash ponds, and evaporative tossed tram two Mined ponds), dewatedng o1 the gravel pit, water lost in the <br />mined product (7.36acre-feeuyear), dust centroi (4.50 eve-teeftyear). <br />6) The maximum pumping rate Is rimitetl ro 3,0~ galklns per minute for dewatering purposes. Pursuant to Policy 2000-4 of the State Boom of <br />Examiners of Water Weti ConsWCtlon and Pump Inslallatlbn Contractors (Board), no pumping equipment shall be installed In the gravel pit <br />well ro withdraw water fw any benefidal use, unless a separate written request fw a variance has been approved by the 8card. <br />7) The owner shall mark the wall (gravel pit pond) in a rnnspkuous place with well permit number(s) and court case number(s) as appropriate. <br />The owner shall take necessary means and precautions to preserve these markings. <br />8) A totalizing Bow meter must be Installed so as to measure any pumping from this gravel pit pond and maintained fn good working order. <br />Permanent retards of all diversions hom the gravel pit pond, ronage of mined product, and the Surface area of ground water exposure shall 1x3 <br />maintained by the well owner (recorded at least annualty) and submitted to Me Division Engineer upon request. <br />9) Pursuant ro Rule 10.1.8 of the Water Well Construction Rules, gravel pit wells are exempt from the minimum well wnsWcfion standards <br />except fw contamination consideretions as stated in the Rule. The owner of the gravel pit shall take necessary means and preceutlons to <br />prevent contaminants from entering the gravel pit well. <br />10) Pursuant to Rule 17.1.4 of the Water Well Construcibn Rules, the owner shall submit, after initladon of censWCtlon, site plan and voss <br />section drawings on 8-1/2" x 11' paper showing the extent of Intended excavation, the maximum depth of the pit, and the initlal static water <br />level.
