The land is presently being used for equipment <br />storage, equipment maintenance, and warehousing of parts and <br />supplies for a construction business. The land was purchased <br />in 1988 by Pete Klein and kichard Zanett who provide contract <br />services to companies and individuals through their <br />company, ZMK Mine Construction, Inc. <br />~/ 2. The area that is presently being used as described <br />above, which includes the area in the Ponderosa trees and the <br />area between the Ponderosa tree boundary and the existing berm, <br />will continue to be used in this manner following reclamation. <br />The area between the existing berm and the east property line, <br />as shown on Er.hibit E - Reclamation Flan Map, will provide <br />Wildlife Habitat. The protection of the mature cottonwood <br />trees near the east boundary, the planting of additional <br />cottonwood trees in designated areas, the ~:1 slopes and <br />rip-rap will all support this use. <br />~3. Although the application was Notarized by the Deputy <br />Ouray County Clerk and Recorder, attached is a new "Signature <br />F'age" with a different Notary Public. <br />Exhibit B - Site Description <br />As described in the revised Exhibit A - Legal <br />Description and as shown on the revised Exhibit E - Map, the <br />permit area has been changed to include the equipment storage <br />area as per Er.hibit C - Mining Plan, Adequacy Item 1. The <br />fallowing lists all of the man-made structures within 200 ft of <br />this revised boundary: <br />Ouray County Road 23 <br />San Miguel Power Company Poles/Transmission Line <br />U5 West Underground Telephone Line <br />Fellin Woven-Wire Fence (West of CR 23> <br />Fellin Irrigation' Ditch (West of CR 23) <br />Walz Primitive Access Road <br />Ditch - Klein/Zanett, Fellin (Assumed to have been <br />constructed to move overflow high water <br />northward away from CR23) <br />2. Attached is a copy of a letter from San Miguel Power <br />Company indicating they have inspected the area where the <br />powerline crosses this property. They also indicate that if <br />any alterations need to made to their facilities, ZMk; will need <br />to abide by their current line extension policy. Please note <br />that in the original ZMF: application, the power pale on the <br />east side of the property was within the prgposed Phase II <br />e;:cavation area. The revised Phase II area allows for a group <br />of mature cotonwood trees to not be disturbed and to be <br />Page 1 <br />
