As you discussed, this facility is not yet constructed or <br />operational, and just obtained the CDMG permit this week for mining sand and gravel. Presently, the site is on <br />agricultural farm land in the vicinity of La Junta which has been flooded out from the excessive rains in the area. In order <br />for conswction at the site to begin, you have proposed pumping out ground water from an existing irrigation well, which <br />would then go into the Arkansas River. The Division has determined that this proposed activity from the existing well <br />will not require a Colorado Discharge Permit System (CDPS) discharge permit; however, the following two best <br />management operational practices will need to be followed for this type of dischazge. Total suspended solids and sediment <br />in the discharged water should be contained by hale bales or other comparable structures so that the amounts of suspended <br />solids is reduced in the discharge going into the Arkansas River. The rate of discharge should be managed so that there <br />is no erosion of the banks or drainage areas in the vicinity, and so that there are no sludge banks or deposition of solids <br />downstream from the dischazge. <br />If the discharge should involve excavation in the ground to install a sump pump or other ptunping system, or if this is done <br />during the later construction excavation phases for this facility, you will first need to obtain a CDPS general permit for <br />construction dewatering.
