That the Mined Land Reclamation Division allo a public <br />hearing be held on the Willow Bend application. <br />2. That Applicant be required to address the followi g criteria: <br />A. The affect on aquatic life in the river by intentional <br /> or unintentional creation of sediment by t is proposed <br /> operation. <br />B. Affect of sediment created on pump equipmen at Franks <br /> Pump Site No. 2 located in NW}NW}NW}, Section 3, <br /> Township 35 North, Range 9 West, N.M.P.M. , La Plata <br /> County, Colorado, which is directly acros the river <br /> from the proposed pit. <br />C. The affect on stream bed elevation change ca sed by this <br /> proposed excavation. <br />D. The inevitable relocation of stream bed caused by <br /> proposed excavation and consequent erosion created by <br /> same. <br /> This eventual moving of the stream bed to t west will <br /> cause property belonging to Simmons Land and Cattle <br /> Company to lose its river frontage, since t at land is <br /> described in a metes and bounds legal" description <br /> without regard to edge or centerline of the Animas <br /> River. <br />3. Applicant should be required to do a water augmentation plan <br />to determine the affect caused by the creation o a six-acre <br />lake on the edge of the river. <br />
