Gattany <br /> y Division Director <br />RE: Coulson Excavating Co., Inc., Application No. M-2005-033 Natural Resource Trustee <br />Gardels Pit; Adequacy Review ~ <br />Dear Mr. Coulson, <br />Listed below are adequacy review comments on the Gardels Pit New 112 Application, Permit Number M- <br />2005-033. The Division of Minerals and Geology (Division) is required to make an approval or denial <br />decision no later than August 16, 2005, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated <br />in the local newspaper, all owners of record of surface lands, easement holders, and owners of record <br />of surface lands that are within 200 feet of the boundary of the affected land. Proof of notice maybe <br />return receipts of a Certified Mailing or by proof of personal service. <br />2. One of the property owners north of the proposed Gardels pit is listed as Garden Gate Development <br />and the area appears to have been subdivided. Please state if any of the parcels have been sold. If so, <br />the individual owners will need to be notified of the application as per Rule 1.6.2(1)(8) and meet the <br />requirements of Rule 6.4.19 if any structures are in place. <br />3. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or <br />other qualified person. The maps submitted to the Division were not signed. Please resubmit a <br />signed copy of the maps. <br />Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan Maps <br />4. Per Rule 6.4.3(8), the applicant will need to depict the owner's name, type of structure and location of <br />all significant, valuable and permanent man-made structures on the area of affected land and within <br />200 feet of the affected land. Please identify the owners of all roads, ditches, pipelines, gas lines, gas <br />wells, utility lines, water wells, fences, etc... on and within 200 feet of the affected land. <br />5. Rule 6.4.3(f) requires that all water wells in the surrounding area be identified on the map. The <br />Division could not locate any water wells on the exhibits. Please locate the wells on a map and state <br />the owners of the wells. <br />6. Please include the name of all creeks, rivers and ditches on Exhibit C-l. <br />7. The applicant provided contour lines on Exhibit C-1 but did not include any values with the contour <br />intervals.
