Gardels Pit; Adequacy Review ~
Dear Mr. Coulson,
Listed below are adequacy review comments on the Gardels Pit New 112 Application, Permit Number M-
2005-033. The Division of Minerals and Geology (Division) is required to make an approval or denial
decision no later than August 16, 2005, therefore, your response to the following adequacy review
concerns should be submitted to the Division as soon as possible.
1. As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice circulated
in the local newspaper, all owners of record of surface lands, easement holders, and owners of record
of surface lands that are within 200 feet of the boundary of the affected land. Proof of notice maybe
return receipts of a Certified Mailing or by proof of personal service.
2. One of the property owners north of the proposed Gardels pit is listed as Garden Gate Development
and the area appears to have been subdivided. Please state if any of the parcels have been sold. If so,
the individual owners will need to be notified of the application as per Rule 1.6.2(1)(8) and meet the
requirements of Rule 6.4.19 if any structures are in place.
3. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or
other qualified person. The maps submitted to the Division were not signed. Please resubmit a
signed copy of the maps.
Rule 6.4.3 Exhibit C- Pre-Mining and Mining Plan Maps
4. Per Rule 6.4.3(8), the applicant will need to depict the owner's name, type of structure and location of
all significant, valuable and permanent man-made structures on the area of affected land and within
200 feet of the affected land. Please identify the owners of all roads, ditches, pipelines, gas lines, gas
wells, utility lines, water wells, fences, etc... on and within 200 feet of the affected land.
5. Rule 6.4.3(f) requires that all water wells in the surrounding area be identified on the map. The
Division could not locate any water wells on the exhibits. Please locate the wells on a map and state
the owners of the wells.
6. Please include the name of all creeks, rivers and ditches on Exhibit C-l.
7. The applicant provided contour lines on Exhibit C-1 but did not include any values with the contour
intervals. Please revise the map to reflect the pre-mining contour elevations at the site.
