<br />Revised 1/26/80 <br />Section 785.19(c) Continued <br />...The definition of alluvial valley floors at Section 701(1) of the Act <br />does not distinguish between natural and artificial subirrigation areas <br />as determinative of the existence of an alluvial valley floor. the <br />Office has deleted the exemption, but does not intend to conclude that <br />areas of artificial subirrigation necessarily indicate the presence of <br />an essential hydrologic function of subirrigation. This decision is <br />further suggested by the appearance of the adverb "naturally" modifying <br />"subirrigated" in 510(v)(5)(A) of the Act. Congress concluded that it <br />was necessary to distinguish natural and artificial subirrigation for <br />• the purposes of determining significance." See 44 Fed. Reel. 15088 <br />(March 13, 1979). <br />The essential hydrologic functions of the floodplain of Foidel Creek <br />will not be adversely affected. As documented in Section 780.21, adverse <br />changes in the quality and quantity of surface and ground water will be <br />prevented by a system of sedimentation ponds, sediment control measures, <br />proper mining and reclamation techniques, and frequent monitoring of <br />discharge water quantity and quality. <br />The hydrologic consequences of mining discussed under Section 780.21(c) <br />will not result in disruption of the essential hydrologic functions of <br />. any alluvial valley floors in the adjacent area, due to the beneficial <br />765-9(jj) <br />
