Since no slope exceeds <br />20° this section 785.15 is not applicable to Energy Fuels' operations. <br />Section 785.17 Prime Farmlands. <br />Since no prime farmlands were found in the pre-application investi- <br />gation required by 30 CFR 779.27, the requirements as presented in <br />this Section are not applicable to the present permit application. <br />Support for this conclusion can be found in the discussio.~ docu- <br />mented previously under Section 779.27. <br />Section 785.18 Variances for delay in contemporaneous reclama- <br />tion requirement in combined surface and under- <br />ground mining operations. <br />• (a) Scope. This Section applies to any person who conducts or intends <br />to conduct combined surface mining activities and underground mining <br />activities, where contemporaneous reclamation as required by Section <br />816.100 is not practicable and a delay is requested to allow underground <br />mining activities to be conducted before the reclamation operation for <br />the surface mining activities can be completed. <br />(b) Objective. This Section is to allow for delay in reclamation of <br />surface mining activities, if that delay will allow underground mining <br />activities to be conducted to ensure both maximum practical recovery of <br />coal resources and to avoid multiple future disturbances of surface <br />lands or waters. <br />(c) Application contents for variances. Any person who desires to <br />obatin a variance under this Section shall file with the regulatory <br />authority complete applications for both the surface mining activities <br />and underground mining activities which are to be combined.
