3. I hereby certify that the accelerated Whole Effluent Toxicit~ testing is being <br />conducted for Outfall 002W, acute P. promelas, for the 2" quarter WET test <br />failure. Bowie's routine WET test performed in August, which passed, is <br />considered to be the first accelerated test. Bowie performed a second additional <br />accelerated test the week of October 18, 2004 and it failed. A third WET test was <br />performed the week of November 15, 2004 and it passed. Bowie now has two <br />tests that passed (August and November 15`h) and one failure (October 18th) on <br />its accelerated testing. A fourth test will be performed the week of November <br />29th. If the November 29`" test passes, the toxicity episode will be considered to <br />be ended. <br />4. One of the problems with maintaining compliance with total suspended solids is <br />the volume of mine water,that is treated in the sediment ponds_ The volume of <br />mine water requires the pond be discharged before adequate settling has <br />occurred. Bowie intends to change its method of handling mine water. In the <br />near future, mine water will be treated (settled) in large underground sumps. <br />The mine water will then be discharged directly to the surface at permitted outtall <br />006. We expect to have this new mine water handling system in place during <br />February 2005. In addition building two new equipment washdown bays with oil <br />collection systems to reduce problems with oil and grease. Our other oil <br />collection sumps were cleaned. We will be more diligent in this effort. <br />5. We performed a compliance audit on the DMR's and did detect some minor <br />mistakes in reporting on the DMR's.
