999
TO: Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203
Attn: Mr. Carl Mount
FROM: Mr. & Mrs. Charles Brody
5001 E. 88th Avenue
Henderson, CO 80640

RFrEIVEG
DEI; u 1 1994
L)IVISien UI mmridia v ucw„i
I am writing in reference to the letter sent on October 31, 1994 by ADCO Consulting (Cherokee
Investment, Inc. Of Thorton, CO). The Public Notice indicated that the Cooley Gravel Company
of Lakewood, CO had filed an application for a reclamation permit to mine the "Dahlia North
Resource Pit" (located at or near Section 19, Township 2 South, Range 67 West, 6th Prime
Meridian) was filed with your office.
Based upon the public notice, we were asked to voice any comments or concerns:
#1. Our Surface Well: Located approximately 250 feet west and 600 feet to the south of the
property line boundary for the project. The bonded well is 33 feet deep to bedrock and
has a 1 HP submergible pump. If the water table should fall (which happened during the
initial digging), what provisions would be made for our outside watering needs? This is
the only outside well on the property and ftdfills the watering requirements for gardens,
lawn, shrubs, and trees throughout the l0' acre property.
#2. Air Pollution: The dirt and dust from beans have been a source of concern in the past.
(The summer of 1994 brought on at least one dust storm, from the current project, that
left near zero visibility.) With beans now to the North, Northeast, and East, what
precautions have been made to reduce the risk of future problems? What is our recourse
as property owners?
The Cooley Gravel Company has been a good neighbor. I have voiced our concerns to their
representatives and they have indicated they would "take care of any problems" that caused
damage or discomfort. I would want that commitment to "take care" of problems or concerns as
part of the public record. I also want to insure that they stay within the 50 ft. Perimeter boundary
for mining. We do not wish to stop the mining; only to ensure that all necessary precautions are
taken.
Thank you.
Respectfully,
Charles and Dorothy Brody
