4. At the time of the inspection, Mr. Stephen Fearn was the operator of the wastewater treatment
facility. Mr. Feam was under a "compliance schedule" to become a fully certified wastewater
treatment operator at the appropriate level by June 30, 2004. At the time of the inspection, Mr.
Feam had not complied with the compliance schedule and was not a fully certified Wastewater
Treatment Operator in Responsible Charge for this facility. See attached letter.
Stormwater Permit Comuliance Inspection
The facility was inspected to confirm its compliance with the CDPS stormwater requirements. Fihdings
of the inspection are noted below:
Violations
During the inspection, the following violations of your stormwater discharge permit were noted and
need to be brought to your attention:
5. In November 2003, the CDPS Stormwater Discharge Permit (# COR-040052) for the Site was
transferred From Sunnyside Gold Corporation to Gold King Mines Corporation. Gold King
Mines is required to amend the project's SWMP whenever there is a significant change in
design, construction, operation, or maintenance, or if the SWMP proves to be ineffective in
controlling pollutants in stormwater discharges. Amendments to the plan must be submitted to
the Division with the following Annual Report. At the time of the inspection, Gold King Mines
had adopted the old Sunnyside Goki SWMP in its entirety. Gold King Mines had not yet made
any amendments to the SWMP.
6. Gold King Mines is required to submit an Annual Report, covering thetwelve-month period from
January 1 through December 31 of each year, on the facility's overall compliance with the
SWMP. The Annual Report is due to the Division on or before Febnaary.l5 of each year.
At the time of the inspection, an Annual Report for the year 2004 had not been prepared or
submitted to the Division.
7. Gold King Mines is required to make a comprehensive inspection of its stormwater
management system at least twice per year. These comprehensive inspections must be
documented and summarized in the Annual Report. At the time of inspection, there was no
documentation of any comprehensive inspections.
8. Gold King Mines is required to submit payment of an annual fee as set forth in the Colorado
Water Quality Control Act. At the time of inspection, Gold King Mines had not yet submitted
payment of annual fees for 2004 and/or 2005.
This letter is your notification that the conditions at your facility as listed above constitute
violations of your industrial wastewater discharge permit (CDPS No. CO-0027529) and needed
actions on the part of Gold King Mines Corporation.
Please provide a written response addressing each of the issues listed above before February 2, 2006.
Your response must outline the course of action that has or will be taken to:
a. comply with the Notice of Violation/Cease and Desist Order (Number: 10-040923-1);
b. comply with the Notice of Violation/Cease and Desist Order (Number: 10-041115-1);
c, comply with your CDPS Stormwater Discharge Permit (# COR-040052).
