<br />-2- <br /> <br />determined that your proposed work, as described, will have no <br />affect on any listed or proposed endangered or threatened species <br />or its critical habitat. <br />This verification will be valid for 2 years unless the <br />nationwide permit is modified, reissued or revoked. The <br />verification will remain valid if, during that time, the <br />nationwide permit is reissued without modification or the <br />activity complies with any subsequent modification of the <br />nationwide permit authorization. If the nationwide permit <br />authorization expires, is suspended, revoked, or modified such <br />that the activity would no longer comply with the terms and <br />conditions of the nationwide permit, the provisions of 33 CFR <br />330.6(b) will apply. <br />With regards to the two road crossings south of the Red <br />Canyon Quarry and Stack properties. On February 8, 2000, we <br />discussed how to resolve the flooding situation. First the lower <br />(south) crossing, under the Nationwide Permit No. 3 for <br />maintenance, you have the option of repairing/cleaning the <br />existing culverts, if needed, and/or adding additional <br />'~ culvert(s); also authorized by Nationwide Permit No. 14 for road <br />crossings, the crossing could be excavated to provide a low water <br />crossing or bridged to allow storm water to pass without the road <br />acting as a retention dike. The upper crossing (north) is over <br />an overflow tributary from the main stem of Red Creek. The road <br />acts as a low water crossing once flows surpass the culvert. In <br />order to maintain flows within the stream channel at this <br />location, we suggest placing several boulders on the south side <br />of the channel where it will keep the flows from flowing into the <br />barrow ditches on each side of the road.
