PERMIT NO.: CO-0032115, AMENDMENT: to exempt from WET testing when ao mine water/spoils spring water is discharged to tributaries to the Yampa River 1M'EIYDED C[VIL PENALTIES Purpose of Public Notice: The purpose of this notice is to state the intept of the Water Quality Control Division to petition for the impositiop of a penalty agaipst the Center Sanitation District. The Divisiop will neck imposition of a penalty of SI9,418 of which 59,709 is to be conditionally suspepded. This penalty is sought pursuant to the Water Quality Control Act, S 25-8-608, C.R.S., for violation of the conditions of CDPS Permit No. CO-0023035 as allegod in the Notice of V'wlatioa and Cease and Desist Order issued by the WQCD oa November 22, 1993. The Center Sanitation District is located in Saguache County, Colorado and is authorized to discharge trrated wastewater to an umamed drainage ditch. Tentative Determination: State tentative determinations have been made is conjunctiop with the U.S. EPA that limitations and eopditions imposed is these permits implement all applicable statutes and regulations and water quality standards. Public Meetines: Permit Adipn: Pursuant to 25-8-502(3)(b), by Derxmber 8. 1997, interested persons may submit a written request for a public meeting on the tentative determination. The Division, after considering all requests, may grant a public meeting for good cause shown. It will be held within sixty (60) days of the date of public notice. Public Comments: Permit Actions: Pursuant to 25-8-502(3)(c) interested persons may submit written comments on Ute tentative determiaatiop provided they are received by the Division by November 17. 1997. All wtttmeats received prior to said date will be considered is the formulation of final conditions and limitations. if a public meeting is held, the public comment period shall close sixty (60) days following the public police. Following the public comment period and the public maetiag, if one is held, the Department will issue or deny the final permit. Iaterrsted parties rhea have thirty (30) days to request as adjudiratory hearing on the permit. Material Iniurv to Water Riehts: In accordance with C.R.S. 25-8-104 (2) (d) (1989), any person who believes that nay actions proposed in this notice have rho potential to cause material injury to a water right is advised to contact the Division, in writing by December 8. 1997. The written notification should explain how the material injury wil{ be incurred.
