BANTA, Director <br />April 6, 1989 <br />Mr. Jerry Koblitz <br />Permittee Liason <br />Wyoming Fuel Company <br />12055 West 2nd Place <br />Lakewood, CO 80215 <br />Re: Hydrology, Canadian Strip Mine; C-81-026 <br />Dear Mr. Koblitz: <br />Following a perusal of the permit application, I found some information about <br />Pond 3, which I confirmed during a telephone conversation with Glenn Murdoch. <br />The original Figure 2 of the permit application, dated March 31, 1981, showed <br />Pond 3 at its current locations. It apparently was constructed after lengthy <br />discussion about erosion from the upslope haul road. During the 1986-1987 <br />reclamation there was discussion about removal of the impoundment, but it was <br />felt that removal was inappropriate until vegetation success could be ensured <br />on the road and contributing drainage area. <br />Wyoming Fuels represented to the Colorado Department of Health (DOH) that <br />Pond 3 was removed when the NPDES permit was reissued on August 26, 1987. As <br />this is not the case, I would like Wyoming Fuels to notify CDOH of Pond 3's <br />existence and apply for an appropriate amendment. Alternatively, Wyoming <br />Fuels could apply for pond removal (per Rule 4.05.2(2)). Furthermore, it <br />would be prudent to prepare a quarterly self-inspection of ponds document and <br />to find the certification for Pond 3 prior to the next complete inspection. <br />I have found a cover letter dated February 6, 1981 from John Althouse to <br />Bob Liddle for the certification of Pond 3 in Appendix Q of the permit appli- <br />cation. Please check your files for the actual certification. <br />I have enclosed a copy of our records checklist for your use.
