Cattany <br />. <br />Florence, CO 81226 Division Direttar <br />Natural Resource Trustee <br />RE: 2005 Quarterly Report Review, Raton Creek Mine, Permit No. C-82-055 <br />Mr. Patterson: <br />The Division of Minerals and Geology has completed review of the 2"d quarter reporting <br />submitted for the sediment pond, discharge monitoring reports, and waste pile at the Raton <br />Creek Mine, #C-82-055. P/ease consider our comments and make any necessary changes or <br />adjustments in future reporting to the Division. <br />Discharge Monitoring Reports tDMR) -The DMR's submitted and reviewed reflects observations <br />consistent with Division monthly inspections. No discharge from the single sediment pond was <br />recorded and/or sampled. <br />Sediment Pond Inspection- The report documents the depth and elevation of the impounded <br />water and the existing storage capacity for both sediment and water as required by Rule <br />4.05.9(14) and (15). Also, a registered P.E. has certified the 2nd quarter report and the report <br />clearly states that the "impoundment has been... maintained as designed, and in accordance <br />with the approved plan and the applicable regulations', as required by Rules 4.05.9(14) and <br />(15). The report also demonstrates compliance with Rule 4.05.9(17) for impoundments. <br />Observations are consistent with field observations noted during Division inspections periodically <br />throughout the year. <br />Waste Pile Inspections -The report meets the requirements under Rule 4.09.1(11) and <br />4.10.2(2). <br />We have no further questions or comments at this time.
