The inspections were conducted on December 13`h & 14th, 2006. Note that <br />Ponds C, D, E, F, and G, were not flowing during the inspection. Ponds B, 62 (Fish <br />Creek Tipple) and the four waste water treatment ponds were flowing during the <br />inspections. All discharge ponds were functional. Standard vegetation clearance, <br />dredging, and minor maintenance are planned for some sites during the summer of <br />2007. <br />Pond E was not flowing at the time of this inspection, however as you are awaze, Pond <br />E was filled with coal fines when a pipeline coming from the coal wash plant ruptured. <br />The break was discovered on September 11`h. Water from Pond E flowed into Foidel <br />Creek sometime following the pipeline break through September 21s`. Cleanup and <br />removal of coal fines deposited along the Pond E weir channel, and Foidel Creek are <br />on going, through the use of high pressure water spray and vacuum truck use in <br />combination with the damming of strategic catch basins. <br />This information is submitted in compliance with Twentymile Coal Company Permit <br />C-82-056 and Rule 4.05.6(13). The inspections were conducted by a qualified <br />individual under the direction of Michael Ludlow, a registered Professional Engineer <br />in the state of Colorado (see next page). <br />
