Lung <br />Division Director <br />RE: Water well complaints; Greeley West Pit, Permit No. M-77-081 <br />Bucklen Equipment Company Pit, Permit No. M-82-131- <br />Dear Mr. Andrews: <br />This is in reference to the Division's ongoing investigation of your <br />complaints about declining water levels in your groundwater wells <br />during the past year. <br />The two sand and gravel operations captioned above are located north of <br />your water wells. The Division of Minerals and Geology required each <br />operator to submit ground water monitoring plans for their respective <br />operations. After reviewing those monitoring plans and related data, <br />the Division is unable to determine whether these operations are having <br />any affect on your wells. <br />The Division of Minerals and Geology regulates the extraction of <br />construction materials under jurisdiction of the COLORADO LAND <br />RECLAMATION ACT FOR THE EXTRACTION OF CONSTRUCTION MATERIALS (the ACT). <br />Reclamation performance requirements for water related issues are <br />outlined in C.R.S. 34-32-116(4)(H), which states: <br />Disturbances to the prevailing hydrologic balance of the affegted land <br />and of the surrounding area and to the quality and quantity of water in <br />surface and groundwater systems, both during and after the mining <br />operation and during reclamation, shall be minimized. Nothing in this <br />paragraph (h) shall be construed to allow the operator to avoid <br />compliance with other statutory provisions governing well permits and <br />augmentation requirements and replacement plans when applicable. <br />We believe that your complaints are issues involving injury to water <br />rights and are more appropriately handled by the Colorado Office of the <br />
